We believe that the relationship between BayTSP and the Internet Service Providers (ISPs) with whom we work will be beneficial to us all in promoting growth and education while we help them to enforce their copyright abuse policies and procedures.
When releasing digital content that’s propagation may result in legal action, it's best to engage with BayTSP at least eight weeks before the official product release – before the asset reaches distribution through the Internet. This allows BayTSP to begin monitoring for first propagators well in advance of official product release.
When BayTSP identifies a potential first propagator, the system automatically collects identifying information on the individual. BayTSP staff then validates the file. Once the file has been validated as the client's intellectual property, the system can then be selected to monitor all subsequent downloaders. Monitoring subsequent downloaders provides information that can be used in court to demonstrate damages caused by the first propagator's actions.
The information that BayTSP collects includes the propagator's IP address, the date and time the individual was identified, the name of the Internet Service Provider linked to the IP address, and the name, size and hash number of the file that the first propagator is distributing.
